MELBOURNE - A police officer, who picked up a woman celebrating New Year’s Eve and then drove her to a wooded area before asking her to give him oral sex, has lost an appeal to his misconduct case.

According to the Daily Telegraph, the court ruled in the woman’s favour after it found her version of the incident to be more credible, and upheld the police officer’s dismissal from the force for serious misconduct, even though an earlier criminal case had been dropped, News.com.au reported.

The Industrial Relations Commission heard then-Detective Constable Samuel James Alan Becke and his partner Constable Adam Currell had picked up the woman in the early hours of New Year’s Day 2008 after she could not find a taxi outside the Mean Fiddler Hotel in Rouse Hill.

The woman, identified as Ms H, had phoned an off-duty police friend after she couldn’t hail a cab. The off-duty officer called on-duty Currell and he and Becke picked the woman up in their police vehicle.

After Ms H got in the car she directed them to a friend’s house in Woodcroft, but Becke ignored her directions.

He drove to a wooded area at the end of Woodcroft Drive and led Ms H for about 30m to some bushes where there was a mattress.

“I am married, I am not one of those girls, I don’t do this,” she had protested.

Despite this, she said Becke pulled down her dress and bra, exposing her breasts.

Becke claimed the whole thing was a practical joke, however Justice Conrad found this was “vague, inconsistent and not credible”. (ANI)
